Subd. 16(E)(1): Hardcover nithin 75*: No <br />hardcover or impervious surface shall be placed, located or constructed within 75 feet of <br />the Ordinary High Water Level of any lake or tributaiy. <br />2. Section 10.56. Subd. 16 (J)(2): Grading/filling of more than 10 cubic yards within <br />75’: Grading, filling or excavating of more than 10 cubic yards is prohibited within 75 ’ of <br />the Ordinary High Water Level of public waters. <br />3.Section 10.56, Subd. 16 (J)(3): Driveways within 75*: Drivewa\s shall not be <br />constructed within 75 ’ of the Ordinary High Water Level of public waters. <br />Application Summary: <br />The applicant requests variances to construct a 125 s.f. driveway and pad, located 50' south of <br />the centerline of Long l,ake Creek where no hardcover is permitted, and grading, filling or <br />excavating of more than 10 cubic yards within 75 ’ of the Creek, to serv e as the access to a future <br />home. <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 6 to 0 vote to: <br />Approve application as pre.sented with the following conditions: <br />1. A 15” culvert must be located underneath the driveway pad; <br />2. A grading pennit application shall be made with the City for no more than the grading <br />and filling necessary to construct a 25’ x 25’ driveway pad; <br />3. Erosion control measures should be installed, inspected and approved by the City <br />prior to any construction activity; <br />4. fhe applicant is advised that future driveway construction within 75 ’ of the Creek <br />will require additional future approvals. <br />STAFF RECOMMENDATION: <br />To appro\ e the enclosed resolution, <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
