't <br />A RESOLUTION <br />GRANTING VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 AND 2; <br />SECTION 10.55, SUBDIVISION 8; AND <br />SECTION 10.56, SUBDIVISIONS 16(J) AND 16(L) AND <br />GRANTING A CONDITIONAL USE PERMIT <br />PER SECTION 10.03 SUBDIVISION 19 <br />- FILE #02-2854 <br />WHEREAS, Kevin and Janet Manley (hereinaAer "the applicants") are the <br />owners of the property located at 1973 Fagemess Point Road within the City of Orono <br />(hereinaAer "City") and legally described as follows: <br />Lots 7, Fagemess, Hennepin County, Minnesota (hereinaAer "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8; and 10.56, <br />Subdivision 16(J) and 16(L) to permit the construction of boulder retaining walls constituting <br />hardcover in the 0-75' zone where no hardcover is normally allowed, and to permit grading and <br />land alterations within the 0-75' lakeshore protected area where such work is normally <br />prohibited. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #02-2854. <br />The property is 0.24 acres in area and is located in the LR-IC Single Family <br />Lakeshore Residential Zoning District. <br />3.The Orono Planning Commission reviewed this application on December 9, 2002 <br />and again on January 22, 2003 pursuant to referral by the City Council. On <br />January 22, 2003 the Planning Commission on a vote of 6-1 recommended <br />approval of a hardcover variance to allow hardcover in the westerly 0-75' zone <br />of the property in the amount of 1,539.6 s.f per revised Option 1 of the <br />Page 1 of 6 <br />I
