rt <br />«ii <br />t 9. <br />K <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2; SECTION 10.56, <br />SUBDIVISION 16 (L); AND <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO. 02-2850 <br />WHEREAS, John Walker and Patricia Walker, (hereinafter "the applicants") are <br />owners of the property located at 1310 Spruce Place within the City of Orono (hereinafter "the City") <br />and legally described as follows: <br />Lots 9 & 10, Block 10, Saga Hill Revised, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicants submitted an application requesting variances to <br />Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) to <br />permit 4,277 s.f. (34%) hardcover in the 75-250’ lakeshore setback, where 4,277 s.f. (34.%) exists <br />and 3,137.5 s.f. (25%) is allowed; and a variance to Section 10.24, Subdivision 5 (B) to permit a <br />deck to be 23’ from the rear lot line where 30 ’ is required in the LR-1B zoning district; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Comnii.ssion held a public hearing on January' 22, 2003, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #02-2850. <br />The property ’s located in the LR-IB Zoning District, where 1 acre is the minimum <br />required lot area.
