Ciiy Couocil Meeting <br />August 20, 2002 <br />Page 4 <br />Ms. Johnson, the beverajse server who sold to an underage person, wa.s present and stated Mr. <br />Lundberg has always stressed the importance of carding persons and that she made a mistake <br />when calculating the age. She thought a card reader machine would have Jiclped. <br />Schaefer asked Chief Good if it was satisfactory for Mr. Lundberg to arrange with the State for <br />his employee's training. Chief Good indicated it was. Sergeant Erickson recommended Mr. <br />Lundberg contact Miles Canning, who was a state licensed trainer the Police Department has <br />used in the past <br />Schaefer stated that she believed Mr. Lundberg was striving to improve his compliance record. <br />She did not believe it was appropriate to suspend Mr. Lundberg's liquor license because Jtat <br />would have an adverse affect on other employees, i.e., cooks who bad nothing to do with tlie <br />liquor violation. She beUeved that mandatory training should be required and that the fine <br />should be reduced to $500. <br />Benson stated he appreciated Mr. Lundberg and Ms. Johnson coming forward and stated he did <br />not believe there was any criminal intent when Ms. Johnson sold to the underage person. He <br />stated Mr. Lundberg was taking steps to avoid his staff making mistakes in the future, including <br />additional beverage server training. Benson suggested lowering the fine to SSOO or SI,000 and <br />that the suspension be waived. <br />Hultmann suggested training be required within 90 days with documentation provided to the <br />City. If documentation is not provided within 90 days, he suggested the one day suspension be <br />enforced. Hultmann was in favor of the $1,500 fine. <br />Pierson agreed with Hultmann. <br />Hammerschmidt tniggested a SI ,000 fine, with the one day suspension waived if the mandatory <br />training is conducted within 90 days. If training is not completed, be suggested the fine be <br />$1,500 and the one day suspension enforced. <br />A motion was made by Hammerschmidt, seconded by Hultmann to direct the dry Administrator <br />to meet with licensee and to enter Into an agreement that waives the hearing and imposes the <br />following sanctions: <br />Ravellos: $500.00 fine <br />Liquor Bam: $1,500.00 fine, one day license suspension, and mandatory training <br />Red Rooster: $1,500.00 fine, one day license suspension, and mandatory training. <br />however, if training is documented to the City within 90 days, the fine will <br />be reduced to 51,000 and the one day license suspension waived. <br />Vote: Ayes: all.
