3. <br />4. <br />5. <br />6. <br />B. <br />C. <br />D. <br />The Orono Planning Commission reviewed this application on January 22 ”>003 <br />and recommended approval by a vote of 7 to 0. <br />The Planning Commission made the following findings of fact: <br />A. The house and deck were constructed in 1968 at this location and require <br />salety improvements as a result of the age of the structure; <br />The replacement of the deck as it currently exists will not increase the <br />existing square footage of hardcover, change the setback from the OH WI nor <br />the average lakeshore setback; <br />The deck is necessaiy to provide a landing for the two sliding glass doors <br />located on the lakeside of the house; and <br />The neighlwring views of the lake are not negatively impacted by the <br />reconstruction of a deck as it currently exists. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />v^i^ces will not adversely affect traffic conditions, light, air, nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a convenience to <br />the applicants, but is necessary to alleviate a demonstrable hardship or difficulty is <br />necessary to preserve a substantial property right of the applicants; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff. commSts^v <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />the 0 Minnetonka where 75' is required, with 5.12% hardcover w ithin <br />75 lakeshore setback zone where no hardcover is permitted and encroaching 71 • into the <br />Page 2 of 5
