The primary issues <br />that need further City review are: <br />1. Whether the second story encroachment can be replaced at the 6' setback; <br />2. Whether the first story encroachment should be allowed to continue at the 6* setback, given <br />that its foundation needs to be replaced. <br />Staff is treating this as a re-opening of the previous variance approval application. In order to <br />expedite the review process, staff recommends that the app|icat>o<^^ be referred to the Planning <br />Commission for consideration at its January 22 meeting, with iuw intent to have this back on <br />Council’s January 27 agenda to consider the PC recommendation and take final action. <br />COUNCIL ACTION REQUESTED <br />Re-open application #02-2753 and refer it to Planning Commission for a recommendation. <br />Optionally, Council may wish to remove this item from the consent agenda and discuss the matter <br />with the applicant, who has indicated he will be present at your January 13 meeting. <br />Proposed Motion: Moved by__, seconded by__, to re-open application U02-2753 and refer it <br />to the Planning Commission further consideration. <br />A.;? <br />I <br />» I <br />I <br />1 <br />1 <br />*
