Sffptenbtr'^UM <br />p«t«2orz <br />Background <br />The applicants received a number of variances in late 2003 for construction of a new <br />home. The applicants have not started construction of that new home within the aliened <br />one year which variance approval provides. The applicants are requesting that those <br />variances be renewed an additional year. If granted the applicants would have until <br />September of 2005 to apply for a building permit. <br />Staff maintains that the conditions under which the 2003 variances were granted still <br />exist and therefore the renewal should be approved. The findings under which the <br />previous variances were approved can be found under the ''Findings of Fact” section of <br />both resolutions (Exhibit C and D). Should the Planning Commission and Council <br />approve the renewal, the resolutions attached as Exhibit C and D would be amended to <br />reflect the 2(X)S deadline and the code sections uould be updated to reflect to re* <br />codification that has occurred since the 2(X)3 approval. <br />Issues for Cousidcration <br />1. Does the Planning Commission find that the conditions under which the 2003 <br />variances were approved still exist? <br />2. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Recommend that the City Council renew the variances approved in September and <br />October of 2003 consisting of a lot area, lot width, 0 - 75 ’ & 250’ - 500’ zone hardcover <br />variances, and a lake setback variance stipulating that a grading plan must be finalized <br />prior to final City Council Approval. The resolutions shall be amended to reflect a <br />September 2005 deadline for building permit submittal, as well as the updated code <br />sections to reflect the re-codification that has occurred since the original approval.
