fo 0\\ <br />M <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 6 9 4 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIMSION 15 <br />FILE NO. #<01.2708 <br />NVHEREAS, Michael McClelland and Jeanje McClelland, (hereinafter The <br />applicanis’) are owners of the propert> locaied at 2170 Minnetonka A\er.je within the City ot <br />Orono (hereinafter ‘The City") and is legally described as follows <br />Lots 4, 5. and 6. Block 8. Mon:ere> cn Minnetonka, except the North 12 feet <br />of said Lots 4. 5. and 6. Hennepin Countv. Minnesota <br />(hereinafter "the property"), and <br />\\T1EREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 17. 2001, at which time all persons desiring <br />to be heard concerning this application were given the opportunity to speak therecn, and <br />NMIEREAS, the applicants applied to the City of Orono for variances to <br />Municipal Zoning Code Section 10.03. Subdivision 15 to permit a 6’ p.'ivacy fence to be <br />constructed within the 50' side >ard adjacent to the street setback where a 3 fence is <br />permitted <br />NOW, THEREFORE, BE IT RESOLVED by the Cit> Council of Orono. <br />FLNDINGS <br />This application was reviewed as Zoning File #01-2708. <br />The property is located in the RR-IB (2 acre) One Family Rural Residential <br />Zoning District <br />The Orono Planning Commission reviewed this application on September 17. <br />2001 and recommended approval on a vote of 5 to 2 for a v ariance based upon <br />Uie following findings and hardships: <br />.Minnesota: <br />I. <br />Page 1 ofS
