Written notice to all property owners wiUiin 350* of the property boundaries ami <br />within 350* of Woodhill Avenue was mailed on Tliursday, April 29, 1999. <br />Additional Permits and/or NotificationsWhlch May Pc Required <br />Other permits which may be required in conjunction with the proposed driveway access include; <br />a) permit for work in right-of-way; <br />b) permit for land alteration; and <br />c) CUP for land alteration exceeding 500 cubic yards <br />Tire above pennits will be held in abeyance pending the result of this land use CL P application. <br />d) Minnesota Statutes requite notification of fee holders when trees arc to he cut w ithin <br />dedicated right-of-way. <br />Application Background <br />In May 1998 Woodhill Country Club did grading work within the Club property and witlrin the <br />dedicated right-of-way of Woodiiill Avenue to re-open a driveway access from tlic Club property <br />to Woodhill Avenue, which access had been closed by the Club since approximately 1980 <br />The City stopped the work upon being advised it had occurred, and indicated to Chib representatives <br />that certain pcmtils and approvals would have to be obtained by die Club in order to retain the work <br />that had been completed and for the access to Woodhill Avenue to be used. <br />Subsequently a number of public and non-public meetings occurred between and among Club <br />representatives, the City Council, staff, and the immediate neighbors potentially affected by the re <br />opening of lire access. Tlic City refused to sanction Woodhill's use of Woodhill Avenue w ithout the <br />proper CLP public review process. Woodhill refused to make such an application In July 1998 the <br />Club filed suit against Orono, claiming that Woodhill has a right to open and use the Woodhill <br />Avenue access without City approval. <br />The lawsuit proceeded with discovery through March 1999. In April 1999 Woodhill proposed a <br />settlement procedure by which Woodhill would apply to the City for a CUP to allow opening and <br />use of the Woodhill access on a limited basis. Woodhill filed tlic cunent application on April 14, <br />1999. This application was deemed by staff to be substantially complete as of April 30,1999 upon <br />receipt of the trafiic study by Parsons Drinckerhoff.
