EXHIBIT G <br />Memorandum <br />Date:April 12,2004 <br />To:Mike Keaveny <br />Paul Ode <br />From;Janice Gundlach, City Planner <br />RE:Restaurant With or Without Liquor <br />This memorandum is intended to confirm our meeting on April 14. 2004 at 10 30am The primary <br />reason for this meeting is to liave a joint understanding about your application, and for City staff to <br />advise you on that application. The followng is a list of issues that you must be aware of when <br />applying for a conditional use permit to operate a restaurant with or without liquor: <br />• In order to continue the process of obtaining a conditional use permit to operate a restaurant you <br />must decide whether you are applying for a restaurant with liquor (Class II) or a restaurant without <br />liquor (Class I). The effects of a Class 11 verses Class I restaurant differ and City staff. Planning <br />Commission, and City Council need to be aware of this when reviewing the site plan <br />• The City Council, at its March 22, 2004 meeting, was clear that it will not support liquor of any kind <br />with a proposed restaurant. I’ve attached those meeting minutes for your review. If you propose a <br />restaurant with liquor (Class II), City staff very firmly believes the application w ould be denied. <br />• If you propose a restaurant without liquor (Class I) it cannot be attached to the bowling alley while <br />the bowling alley/The Crib has a liquor license (3.2% or setup) m effect. OUicrwisc, the only access <br />to the restaurant can be through an exterior door. This issue is not negotiable due to the City's <br />inability to control liquor moving between the bowling alley/The Crib and a restaurant that has an <br />interior connection. <br />• The following are all additional components that need to be apptoved in conjunction with approval <br />of a conditional use permit to operate a restaurant: <br />o Approval of a Commercial Site Plan Review <br />o Approval of a Hardcover Variance <br />o Approval of a Structural Coverage Variance <br />o Approval of Parking Variances (to « of stalls and possibly setbacks to properly lines) <br />• The property is currently far out of compliance with zoning requirements. Based on the Council’s <br />concerns regarding the impacts on the residenual neigh’oorhood of expanding the intensity of the use <br />on the site, the Planning Commission and Council may find that the site is already at or beyond its <br />full capacity. Planning Department staff will work through the application to assist in a plan that <br />gets as close as it can to compliance with the Zoning Ordinance, which ultimately determines <br />whether approval for the restaurant use will be granted <br />If you have any questions regarding Uiis information, please bring them to the meeting scheduled for <br />April 14, 2004 at 10:30am. The City’s goal for this meeting is for all parties involved to be clear on the <br />application that is proposed and to provide you with realistic expectations for the outcome.
