FILE«04-29M <br />27 Fa6ru«ry2004 <br />Pt9t4of4 <br />Staff finds that a hardship exists due to the challenging lakeshore portion of the lot and <br />the need for the hardcover (stairs), justifies granting the variance request for the minor <br />reduction in hardcover. <br />Conditional Use Pcrniit Analysis <br />A thorough evaluation of the water body and the topographic, vegetation and soils <br />conditions on the site have been made, and are addressed by the following: <br />• The prevention of soil erosion or the possible pollution of public waters, both <br />during and after construction; Steps have been taken to address possible soil <br />erosion during and after construction. <br />• The visibutvy v/ $trjctures and other facilities as viewed from public waters is <br />limited; Visibility of the steps and the walls will be minimized by vegetation <br />plantings which will screen the proposed structures. <br />• The site is adequate for water supply and on-site sewage treatment; Xot <br />applicable. <br />• The types, uses and numbers of watercraft that the project will generate are <br />compatible in relation to the suitability of public waters to safely accommodate <br />these watercraft; Not explicable. <br />City Engineer, Tom Kellogg, has reviewed the site and has provided staff with a <br />recommendation (the letter is attached as Exhibit E). The following is a summary of <br />Kellogg’s comments: <br />• The proposed wall will not exceed 3 * in height and will be screened with vegetation. <br />The wall construction is acceptable from an engineering standpoint provided the <br />installation is in accordance with the plans and specifications provided. <br />• Heavy duty silt fence with steel imposts must be installed along the shoreline <br />immediately to protect the exposed slope. The silt fence should be maintained <br />throughout the construction process and remain in place until the slope is stabilized <br />and vegetation is established. <br />Issues for CousidcratioD <br />Are there any other issues or concerns with this application? <br />Staff Rccommcndalion <br />Planning Department staff recommends approval of the proposal subject to the City <br />Engineer’s recommendations.
