Commercial Site Plan Review in order to obtain a building permit to construct an <br />addition to the existing home and to convert it from a residential use to a <br />cormnercial use. <br />2. Parking setback variance to allow a drive through lane and parking spaces to be <br />located within the required 30’ yard. <br />3. Building setback variance to allow a north side setback of 24* when 35’ is <br />required and 24’ feet cunently exists. <br />4. Conditional use permit in order to operate a coffee shop/bakery/restaurant. <br />St^ff RecommeitdatioH: Staff recommends denial of the application as the site cannot <br />support the requested drive through which also creates the need for approval of an <br />uimecessary paridng variance. <br />Pertinent Zoning Ordinance Sections <br />Sec. 78-642. Permit ^plication. All applications for a building permit in any B-1 retail <br />sales business district shall be review^ by the council and may be refened to the <br />planning commission for review. <br />(Code 1984, § 10.40(2)) <br />Sec. 78-646. Area, height, lot width, setback requirements and design requirements. <br />(c) Front yards. The minimum front yard shall be 20 feet. <br />(d) Rear yards. The minimum rear yard shall be 30 feet, a side yard adjacent to any R <br />district shall be 1S feet, and a side yard adjacent to a street shall be ten feet.
