After-the-fact hardcover variatKe within the 7S*-2S0’ zone to allow 58.2% hardcover <br />where 2S% is allowed and S2.2% was previously approved. <br />2. After-the-fact side yard setback variance in order to allow the newly constructed deck <br />to remain at 4.2* from the side lot line where 10' is required and the home is setback <br />3.2 ’. <br />3. After-the-fact average lakeshore setback variance to encroach 3.5* into the average <br />lakeshorc setback with the newly constructed deck. <br />4. After-the-fact structural coverage variance to allow 21.4% structural c . crage where <br />1,500 s.f. (17 %) is allowed <br />Hardship: Staff does not find hardships to support the after-the-fact variances ________ <br />Staff Recommendation: Planning Department staff recommends denial of the after-the- <br />fact hardcover and structural coverage variance requests. _______ <br />PcrtiBcot Zoning Ordinance Sections <br />Sec. 78-281. Setbnek regulations. <br />(a) In any LR-1 A, LR-IB, LR-IC or LR-lC-1 district the setback from the shoreline for <br />lakeshore lots shall be 75 feet for all structures; except that on lakeshore lots divided by a <br />major thoroughfare, a lockbox not in excess of 20 square feet in area and 48 inches in <br />height is allowed on the lakeshore portion of the lot and requires a building permit from <br />the city. <br />(b) No principal or accessory struemre shall be located within 75 feet of the lakeshore nor <br />closer to the lakeshore than the average distance from the shoreline of existing residence <br />buildings on adjacent lots (refer to Orono Manual of Design Standards and <br />Specifications), except that this does not apply to structures allowed in subsection (a) of <br />this section.
