The <br />proposed boulder walls and re-grading of tlie yard were conducted in part to eliminate a <br />sloped area at the shoreline which was eroding and to allow for a flat yard area between <br />the home and the lake. <br />Hardship Analysis <br />In considering applications for variance, the Planning Commission shall consider the effect of the <br />proposed variance upon the health, safety and welfare of the community, existing and anticipated iraf/le <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values of propeity in <br />the surrounding area. The Planning Commission shall consider recommending approval for vaiiances <br />from the literal provisions of the Zoning Code in instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the individual propeity under consideration, and <br />shali recommend approval only when it is demonstrated that such actions will be in keeping with the <br />spirit and intent of the Orono Zoning Code. <br />Should the IMuiming Commission determine that a hardship exists due to the challenging <br />lakcshore portion of 'he lot potentially requiring the boulder retaining walls and the <br />location of the home with respect to the 75 ’ setback then a hardcover variance may be <br />justified. <br />Conditional Use Permit Analysis <br />A thorough evaluation of the water body and the topographic, vegetation and soils <br />conditions on the site have been made as required by code, and are addressed as follow s: <br />3 <br />■i <br />4
