/4TTA«i^/rMvrAjr~ (Z. <br />CITY of OROXO <br />RESOLUTION OF THE CITY COUNCIL <br />• 179NO <br />Dran )»5 • 5/:0/0l A RESOLUTION <br />FSTARUSIIIN^ POLICIES RKCARIMNC; <br />MINIMUM HARDCOVER S TANDARDS <br />FOR GARAGES, DRIVEWAY S, SIDEWALKS, AND <br />SIMILAR PROPERT Y TEA TURKS <br />WIIERT^AS, the City ol Orono since 1975 l>as regulated llie use aiul placement of <br />h iidcoveron land within 1000 feet of lake shorelines; and <br />WHEREAS, City Ordinances define hardcover as "Any stiucturc, blacktop, or other <br />matciiul which intei feres to any degree with the direct absorption of rainfall into the giouiul"; <br />ai>d <br />WHEREAS, the City Ordinances placing limitations on the use of hardcover ilivide the <br />1000-foot regulatory /.one into four tiered "hardcover zones" which arc commonly referred to as <br />"the 0-75* zone", "the 75-250' zone", "the 250-500' /one", and "the 500 1000' zone"; and said <br />/ones are respectively allowed 0% hardcover, 25% hardcover, 30% haulcover, and 35% <br />hardcover; and <br />WHEREAS, due to the hardcover limitations it has become common practice for <br />applicants for building pennits to minimi/c hanlcovcr associated with ilriveways and sitlewalks <br />in ouler to ina.ximize the haulcover available for their stnictural footprint while meeting the <br />established hardcover limits; and <br />WHEREAS, line to the hardcover liniitations, applicants for building pcimits might <br />choose to not iiu hide a garage in their initial pennit request, only to later request haidcover or <br />setback variances for constiuction of garage stalls, and <br />WHEREAS, the ('ity has heretofore not established minimum standaids for garage, <br />diivcway and sidewalk diinensions, and consequently has been faced with proposals for garages, <br />driveways .and sidewalks that arc minimally functional or non functional and which do not <br />provide for safe, efficient access and otT street paikmg needs; and <br />WHEREAS, the City wishes to avoid situations in which poor garage, driveway and <br />sidewalk plant ’iiig, lesults in latei icquest.s lot excessive hardcover; and <br />WIH REAS, the ( ity seeks to establish a balance uiat avoids excessive hardcover while <br />providing adequate functionality with regards to private garages, driveways and sidewalks, ami <br />tlierefoic it is in the best intciest of the City and its residents to establish a policy providing <br />iiiiiiiiuuni struidaids for such fcatuics for propcity subject to haidcover recuiations <br />Page 1 of 3
