The applicant has also proposed to cover this entry <br />with an extension of the roof and pillars as shown in the submitted elevation view. <br />Because the property is currently at a non-conforming hardcover level, 5,984 s.t. or <br />53.05%, a hardcover variance is requested to construct an additional 16 s.f. of hardcover <br />to accomplish the covered entry and a hardcover level of 53.19%. <br />AppUwrU has provided a Hardship Documentation Form in Exhibit C, and should be <br />asked for additional testimony regarding the application. <br />Hardship Analysis <br />In considering applications for variance, the Planning Commission sltail consider the effect of the <br />proposed variance upon the health, safety and welfare of the community, existing and anticipated <br />tra/nc conditions, light and air, danger of fire, risk to the public safety, and the effect on values of <br />Drooerty In the surrounding area. The Planning Commission shall consider recommendmg approval <br />for variances from the literal provisions of the Zoning Code In Instances where their strict <br />enforcement would causa undue hardship because of circumstances unique to the Individual <br />property under consideration, and shall reconmtend approval only when it is demonstrated that such <br />actions will be In keeping with the spirit and intent of the Orono Zoning Code._________________ <br />Staff finds that there is no hardship to grant approval of an additional 16 square feet in <br />order to accomplish a larger, covered entry. The property is currently excessively over <br />on hardcover and should not be permitted to increase that percentage, regardless of the <br />project. <br />However, staff does find that the request is reasonable and a covered entry is something <br />that shotid be permitted. Therefore, staff would recommend approval of the covered <br />entry with the stipulation tliat 16 s.f of hardcover somewhere else on the property be <br />removed so that the hardcover square footage and percentage do not increase.
