Currently, the City is under a moratorium for any wetland alterations or <br />alterations within 26’ of a wetland, as a new Wetland Ordinance is being drafted. <br />Therefore, the City is \mable to determine what, if any, additional City permits would be <br />required if access to a dock is needed through wetland. Staff anticipates this would be <br />allowed under the new ordinance but is unable to review or approve anything at this time <br />due to the moratorium. The Planning Commission should discuss if approval of a lot area <br />variance should be granted without knowing the status of dock access. <br />An alternative >valking and possible vehicular access to the site could be via the platted <br />undeveloped road abutting the northwest comer of the property, and then leading south to <br />the lake west of Lot 19 (see plat map). This lake access point would not, however, be <br />suitable for a private dock to serve the applicant ’s lot. <br />» • ^ • I <br />Issues for Consideration <br />1. Is the Planning Commission comfortable approving a lot area variance without a clear <br />understanding of how a dock will be regulated within any wetlands? <br />2. Is the Planning Commission comfortable allowing this lot to develop as all setb* <br />hardcover and lot coverage standards can be met? Is the Planning Comr^ <br />prepared to grant the same rights to other vacant properties on the island under the j <br />acre standard? <br />3. Are 3-bedroom septic sites appropriate give a S-bedroom requirement and the <br />approval of the City’s Septic Inspector? <br />4. Would a covenant recorded against the property restricting development of a structure <br />to a 3-bedroom septic site be adequate in disclosing the level of buildability to future <br />property owners? <br />5. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Approval of the lot area variance stipulating recording of a covenant that would restrict <br />development of the site to a structure no larger than 3 bedrooms. The applicant is also on <br />notification that a separate land use approval may be necessary to access a dock through <br />delineated wetland, and a dock cannot be constructed until the existing moratorium has <br />lifted and standards are in place and no specific footprint size or orientation is approved <br />with this request. <br />• i
