3. <br />4. <br />5. <br />The Planning Commission reviewed this application at a public hearing <br />held on November IS, 2004 and recommended approval of the lot area <br />variance based on the following findings: <br />a. The lot was legally created prior to adoption of the current RS, <br />Seasonal Recreational District standards. <br />b. A structure can be built on the lot meeting the required 50’ lot line <br />setbacks (to the north and west) as well as wetland, septic and lake <br />setback requirements. <br />c. The property has suitable primary and alternate 3-bedroom septic sites <br />available. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the applicants and the public, and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance would not adversely affect traffic <br />conditions, light, air nor pose a fire hazard or other danger to neighboring <br />property; would not merely serve as a convenience to the applicants, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicants; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive <br />Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a lot area variance to Orono Municipal Zoning Code Section 78-S68 to allow <br />construction of a seasonal cabin on an existing vacant lot consisting of 3.33 acres of total <br />lot area t^ere approximately 1.1 acres of dry buildable area exists and where S acres of <br />dry buildable area is normally required, subject to the following conditions: <br />t, <br />Page 2 of 6
