3. 4. 5. The Planning Commission reviewed this application at a public hearing held on November IS, 2004 and recommended approval of the lot area variance based on the following findings: a. The lot was legally created prior to adoption of the current RS, Seasonal Recreational District standards. b. A structure can be built on the lot meeting the required 50’ lot line setbacks (to the north and west) as well as wetland, septic and lake setback requirements. c. The property has suitable primary and alternate 3-bedroom septic sites available. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a lot area variance to Orono Municipal Zoning Code Section 78-S68 to allow construction of a seasonal cabin on an existing vacant lot consisting of 3.33 acres of total lot area t^ere approximately 1.1 acres of dry buildable area exists and where S acres of dry buildable area is normally required, subject to the following conditions: t, Page 2 of 6
