Vogstroni <br />20840 Channel Drive <br />Greenwood, MN 55331 <br />RE: Illegal Vegetation Removal <br />2618 Casco Point Road <br />PIN 20-117-23-24-0038 <br />On October 12,2004, a “stop work ” order was posted at the above property as vegetation <br />removal was conducted witliin 75’ of Lake Minnetonka and the adjacent wetland without <br />City permits. Vegetation removal and tree cutting within 75’ of the OHWL of Lake <br />Minnetonka and within a wetland requires an inspection by City Staff and a tree removal <br />permit issued by the City Inspector. The soil disturbance caused by the tree removal <br />activity may also require review and approval from the Miiuiehaha Creek Watershed <br />District (MCWD). <br />Removal of individual trees of 6 ” diameter and intensive vegetation clearing within 75’ <br />of a lake or on a slope greater than 30% is strictly prohibited without prior City approval. <br />Orono City Code 78-1285 states; <br />(a) No live tree within 75 feet of the shoreline or within the bluff impact zone with a <br />diameter of 6 inches or more (or 19 inches in circumference or greater) measured 3 <br />feet above the ground may be removed without first obtaining a permit from the City <br />provided that at least the equivalent number of replacement trees of a size and nature <br />found acceptable to the staff are planted at the same setback from the shoreline as <br />those removed. <br />Intensive vegetation clearing within 75 feet of the shoreline, on steep slopes or within <br />the bluff impact zone within the Shoreland Overlay District is prohibited. Limited <br />clearing of shrubs and trees less than 6 inches in diameter and cutting, pruning and <br />trimming of trees of any size is allowed to provide a view to the water from the <br />principal dwelling site and to accommodate the placement of permitted stairways and <br />landings, picnic areas, access paths, beach and watercraft access areas, and <br />permitted lockboxes, provided that the screening of structures, vehicles or other <br />facilities as viewed from the water, assuming summer, leaf-on conditions, is not <br />substantially reduced. <br />Teiepbone (952) 249*46(K) • Fax (952) 249-4616 <br />www.ci.orono.iim.us
