15. Payment to the City of Park Dedication Fee in the amount of S11,100.00 as established <br />in Resolution No. 5099. <br />16. Payment to the City of final plat review fees and legal review and filing fees in tlie amount <br />of $530.00 as established within Resolution No. 5099. <br />NOW, THEREFORE, BE IT RESOLVED tliat based on the findings of Resolution No. <br />5099, the City Council of the City of Orono does hereby approve the plat of SPRING HELL ESTATES, <br />Hennepin County, Mirmesota subject to the following declarations and conditions: <br />1. A variance for lot width for Lot 3 is hereby granted based on the findings noted <br />within Resolution No. 5099. <br />2. <br />3. <br />5. <br />6. <br />7. <br />A variance is hereby granted to allow enci oaclunent of a portion of driveway liardsurface <br />within 75' of the OH WL of Lydiard Lake based on the findings noted within Resolution <br />No. 5099. <br />Lot 2 shall be exempt from meeting the 'average lakeshore setback' standards of <br />the Orono Zoning Code based on the findings noted within Resolution No. 5099. <br />4. Lots 1 and 2 arc subject to City Shoreland regulations regarding protection of the bluff <br />located on said Lots. <br />Setbacks for all principal residence constmetion shall be as depicted on the preliminary plat <br />drawing by Mark S. Gronberg, a licensed surveyor of Gronberg & Associates, bic. dated <br />December 5, 2003, of record in the office of the Planning Director. <br />All identified primary and alternate sew'age system drainfield sites witliin tlie subdi\ision shall <br />be fenced off prior to any land alterations, and such fencmg shall remain in place until such <br />time that each Lot is developed. <br />The private road loop in Outlot A is intended as a one-way counterclockwise circular <br />access and when constructed sliall be constructed to City private road standards, with the <br />exception that the final design minimum paved width and clear area of such loop shall be <br />subject to approval by the City Engineer and City Fire Marshal to ensure adequate but not <br />excessive emergency vehicle access. <br />Page 3 of 5 <br />i
