F M'3 <br />/ <br />CITY OF MEDINANA f <br />ORDINA^NCE NO. 347 <br />AN ORDINANCE ADDING SECTION 829 TO THE CITY <br />CODE REGARDING THE REGULATION OK LIGHTING <br />WHICH AFFECTS THE NIGHTTIME ENVIRONME.NT <br />The City Council of the City of Medina Ordains as follows: <br />SECTION 1: Section 829 et scq. is hereby added to the Code of Ordinances as follows: <br />Section 829.01. Purpose and Intent. <br />Subd. 1 . Sections 829.01 et scq. shall be known as the outdoor lighting ordinance. It is the intent of <br />this ordinance to define practical and efTectivc measures by which the obtrusive asjKCts of excessive <br />and/or careless light usage that affects the nighttime environment can be minimi/ed, while <br />preserving safety, security and the nighttime use and enjoyment of p - -ly. These measures are <br />intended to curtail the degradation of the nighttime visual environment by encouraging lighting <br />practices that direct appropriate amounts of light where and when it is needed, increasing the use of <br />energy efficient sources, and decreasing the wastage of light and glare resulting from overligltling <br />and poorly shielded or inappropriately directed lighting fixtures. <br />Subd. 2. All outdoor illuminating devices shall be installed in conformance with the provisions <br />of this ordinance and the Minne.sota State Building Code as applicable and under appropriate <br />permit and inspection. <br />Section 829.02. Definitions. <br />As used in this ordinance, unless the context clearly indicates otherw ise, the following words atul <br />phrases shall have the meanings given to them: <br />Subd. 1. Certified l.ightiiiv ’. Professional . Any person holding ceilification by the National Council <br />ofOualifications for the Lighting Professions, International Association of Lighting Management <br />Companies or the Association of Energy Engineers. <br />Subd. 2. Class I Liebting . All outdoor lighting used for, but not limited to, outdixu sales or eating <br />areas, assembly or repair areas, advertising and other signs, iccreational facilities and other simihir <br />applications where color rendition is important to presene the effectiveness of the activitv . <br />Designation of lighting as Class I requires a finding by the zoning administrator of the essential <br />nature of color rendition for the application. Class 1 uses include outdoor eating and retail fix^d or <br />beverage service areas; outdoor maintenance areas; display lots; and assembly areas, such as concert <br />or theater amphitheaters. <br />Subd. 3.
