3. <br />4. <br />rhe Planning Commission reviewed this application at a public hearing <br />held on October 18, 2004 and recommended approval of variances to <br />Municipal Zoning Code Section 78-1288 Subdivision B based on the <br />following findings: <br />a. Tlte property has 0.48 acre or 21,217 s.f. iu area and 130’ at the lake <br />and 135’ at the 75’ setback on the west;‘i;i lakeshore side and 69 ’ at <br />the lakeshore and 104’ at the 75’ setback on the eastern lakeshore side. <br />b. The property is located on Fagcrncss Point Road and has 0-75’ <br />lakeshore on two sides. <br />c. There is no additional land available for acquisition by tlie applicants <br />to make the property conforming. <br />d. Tlie proposal will not have a negative impact on light, air or open <br />space within the neighborhood. <br />c. The proposed additions are not out of character for the immediate <br />neighborhood. <br />f. A portion of the western side of the existing home is located within <br />75’ of the OIIWL of Lake Minnetonka. <br />g. A hardcover variance in the 75’-250’ zone is supported by the <br />following hardships; <br />i. The proposal will result in a net reduction of 0-75’ hardcover <br />on the western portion of the property of 327 s.f. or 3%. <br />ii. There is no additional hardcover that can be reasonably <br />removed from the 75’ - 250’ setback zone. <br />h. Each of the proposed additions will be constructed in u conforming <br />location. <br />llie Planning Contmission reviewed this application at a public hearing <br />held on October 18, 2004 and recommended denial of u variance to <br />Municipal Zoning Code Sections 78-1279 and 78-1288 Subdivision A to <br />allow construction of an addition within the westerly 0-75’ setback zone <br />based on tire following findings: <br />Page 2 of 6
