A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. 04-3053 <br />WHEREAS, Bartholomew Butzer and Elizabeth T. Butzer, husband and <br />wife (hereinafter “the applicants”) are the owners of the property located at 2625 North <br />Shore Drive within the City of Orono (hereinafter the “City”) and legally described as <br />follows; <br />See Exhibit A <br />(hereinafter the “property”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for a variance to Orono Municipal Zoning Code Section 78-1279 to allow a dormer on <br />the lake side of the home to be replaced with a larger dormer, while not increasing <br />hardcover, when the house is setback 39 ’ from the lake when 75 ’ is normally required. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #04-3053. <br />2. The property is located in the LR - lA zoning district, which requires a <br />minimum lot area of two (2) acres. The applicant’s lot is 1.97 acres in <br />size. <br />3. The Planning Commission reviewed this application at a public hearing <br />held on October 18, 2004 and recommended approval of the variance <br />based on the following findings: <br />a.
