Staff believes that opening up the possibility of large trucks being stored on 2-aci e <br />lots will become more problematic for oiur neighborhoods as time goes by. Tire 5-acre lot size minimum <br />provides some assurance that a neighborhood of 2-acre lots won’t be invaded by dump trucks. It also <br />increases the likelihood that separation and screening horn adjoining properties will be feasible. <br />The conditions cunently in the Code for storage of a vehicle over 14,000 lbs. GVW are as follows; <br />a. Minimum lot size of 5 acres. <br />b. Property owner must be vehicle owner or operator. <br />c. Vehicle must be set back 50 feel <br />ri Must not be visible Horn rreighbormg propeities and public str eets; vegetative screciring isprefen ed. <br />e. Maintenance of said vehicle shall occur within an enclosed building. <br />f. The vehicle shall not constitute a nuisance at any time. <br />(Note; “Public Nuisarxe ’’ is defmed in the Municipal Code, Section 70-4, as follows: <br />1. Maintaining or permitting a condition which unreasonably annoys, injures or <br />endangers the safety, health, morals, comfort or repose of any considerable number <br />of members of the public. <br />Interfering with, obstructing or rendering dangerous for passage any street, public <br />right-of-way or waters used by the public, or <br />Any other act or omission declared by law- to be a public nuisance ) <br />2. <br />3. <br />g.
