ii <br />\\r<> <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 6 9 4 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 <br />FILE NO. #^01-2708 <br />WHERE.AS, Michael McClelland and Jeanie McClelland, (hereinafter "the <br />applicants") are owners of the property located at 2170 Minnetonka Avenue within the City ot <br />Orono (hereinafter "the City") and is legally described as follows: <br />Lots 4, 5. and 6. Block 8, Monterey on Minnetonka, except the Nonh 12 feet <br />of said Lots 4, 5, and 6, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 17, 2001, at which time all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon, and <br />WHEREAS, the applicants applied to the City of Orono for variances to <br />Municipal Zoning Code Section 10.03, Subdivision 15 to permit a 6' privacy fence to be <br />constructed within the 50' side yard adjacent to the street setback where a 3 ā€˜/i’ fence is <br />permitted. <br />NOW', THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />1 <br />This application w'as reviewed as Zoning File #01*2708. <br />The property is located in the RR-IB (2 acre) One Family Rural Residential <br />Zoning District. <br />3.The Orono Planning Commission reviewed this application on September 17, <br />2001 and recommended approval on a vote of 5 to 2 for a variance based upon <br />the following findings and hardships: <br />Page 1 of 5
