i <br />FILE #04-3050 <br />September 1. 2004 <br />Page 3 of 3 <br />along Minnetonka Avenue measures 175’ in width. <br />RR-IB Standards <br />The proposed house and 988 s.f. detached garage meet all setback, lot coverage, and <br />hardcover standards of the RR-IB district. <br />Driveway “curb cut” <br />The proposed angled driveway, while 20’ wide in section, is about 28 ’ in width where it <br />crosses the lot line and will have to be slightly modified in width or orientation to meet <br />the 20’ limit. <br />Hardship Statement <br />Applicant has completed the Hardship Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Hardship Analysis <br />ht considering applications for variance, the Planning Commission shall consider the effect of the <br />proposed variance upon the health, safely and welfare of the community, existing and anticipated traf/k <br />conditions, light and air, danger offire, risk to the public safety^ and the effect on values of property In <br />the surrounding area. The Planning Commission shall consider recommending approval for variances <br />from the literal provisions of the Zoning Code in instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the individual property under consideration, and <br />shall recommend approval only when it is detnonstrated that such actions will be in keeping with the <br />spirit and intent of the Orono Zoning Code, <br />Staff finds that as the lot is similar in size with the lots in the immediate neighborhood, <br />and that there is no additional land for the property owners to acquire in order to make <br />their lot conforming in area and width. <br />Issues for Consideration <br />1. Although a variance was granted, does the Planning Commission feel that the <br />accessory building located within the right-of-way should be removed as part of <br />this review? <br />2. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Planning Staff recommends approval of the lot width and lot area variances with the <br />following stipulation; <br />1. The new construction will be required to conform to the hardcover, lot coverage, <br />and setback regulations.
