r <br />1 \ <br />WHEREAS, the Minnesota Legislature adopted Laws of Minnesota 2004 Chapter 255 Section 43, <br />which removed Six Mile Creek from the jurisdiction of the LMCO; and <br />WHEREAS, Laws of Minnesota 2004, Chapter 225, Section 43 was passed by the Legislature wittiout <br />consultation with the cities around the Lake, the Department of Natural Resources, the Minnehaha Creek <br />Watershed District, the Lake Minnetonka Association, the Halsteds Bay Preservation Group, or the Lake <br />Minnetonka Conservation District or any of its directors, and was passed without legislative heanngs; and <br />WHEREAS, the LMCD is better able than other state or local agencies to devote the necessary time to <br />the unique issues presented by Lake Minnetonka, afford appropriate protection to the environment and the <br />pubfic health, safety and welfare, adopt and enforce regulations on a uniform lake-wide basis, and mediate the <br />conflicting interests of the many stakeholders in Lake Minnetonka; and <br />WHEREAS. Laws of Minnesota 2004, Chapter 255, Section 43 deprives certain areas of the Lake of <br />the benefits and protection of the LMCD and its regulation of development and use of the Lake; <br />NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Lake Minnetonka <br />Conservation District that: <br />1,It would be in the public interest to repeal Laws of Minnesota 2004, Chapter 255, Section 43. <br />2.The District's legislative delegation is urged to repeal Laws of Minnesota 2004, Chapter 255, Section <br />43 at its earliest opportunity. <br />The Chair is authorized and directed to transmit a copy of this resolution to the members of the <br />District's legislative delegation and to take such other and further steps as deemed reasonable and <br />appropriate to communicate the support of the District for such repeal. <br />Adopted by the Board of Directors of the Lake Minnetonka Conservation District this ___day of <br />_________2004. <br />Tom Skramstad, Chair <br />ATTEST; <br />Jose Valdesuso, Secretary <br />CLL-25I324VI <br />LKIIO-4
