Render for building permit <br />Lot 2, Block 1, Tonltavva Shores Second Addition, Hennepin County, MN <br />Dear Mayor and City Council; <br />I am ^^Titing to outline the situation involving my client’s application for a building <br />permit, <br />James D. Render ONsns Lot 2, Block 1, Tonkawa Shores, Second Addition, and <br />wishes to build a new home on the property. Approximately five years ago Mr. Render <br />applied to replat four lots he owiied (including the subject property) and reduce them to <br />three lots. He now lives in the house next door on Lot 3. When he rcpiatted the property <br />he prepared a plan that was accepted by the City showing the elevation of the portion of <br />Lot 2 in question at 939.5 feet. When he was talking with staff a few weeks ago, they <br />advised him that that would be the “agreed upon” lower elevation for measuring the height <br />of his proposed home - not the 943+ elevation which would be tlje actual ground level <br />around pan of the house. <br />At the time of the platting there was an agreement with City personnel that it would <br />be wise to not fill Lot 2 up to the contours shown on the plan because it probably would be <br />necessary at the time of construction to either place additional fill or haul dirt away from <br />the property. The City agreed that to haul fill twice would be disruptive to the <br />neighborhood and to wail to build the elevation up to 939.5 when construction of the home <br />on Lot 2 was undertaken.
