3. <br />4. <br />5. <br />The Planning Commission reviewed this application at a public hearing <br />held on August 16,2004 and recommended approval of the variance based <br />on the following findings: <br />a. The property is in excess of 100 acres and can therefore support a <br />larger building than is permitted by the Zoning Ordinance. <br />b. The Zoning Ordinance does not specifically regulate sizes of single <br />buildings on properties greater than 9.0 acres. <br />c. The addition to the building will not negatively impact any neighbors <br />or the Luce Line Trail located to the south. <br />d. The addition will meet the required 50 ’ setback from the Luce Line <br />Trail boundary <br />The City Council has considered this application including the findings <br />and recommendation of the Plaiming Commission, reports by City staff, <br />comments by the applicant and the public, and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance and conditional use permit would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to neighboring property; would not merely serve as a convenience <br />to the applicant, but is necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preser\e a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Section 78-418(4) and a variance to Orono Municipal <br />Zoning Code Section 78-1434 (2) to allow an addition to an existing maintenance <br />building which will create % single building in excess of 3,000 square feet, subject to the <br />following conditions: <br />Page 2 of S
