Reserved. <br />Subdivision II. <br />Permits and Certificate of Zoning Compliance <br />Sec. 78-1166. Declaration of nuisance. <br />Any filling, alteration, construction or artificial obstruction of the floodplain and <br />wetlands conservation area is declared to be and to constitute a public nuisance unless a <br />permit to construe* and maintain the obstruction has been obtained in the manner <br />provided in this subdivision. <br />(Codel984,§ 10.55(17)) <br />Sec. 78-1167. Required. <br />A use permit issued by the zoning administrator in conformity with the provisions <br />of this article shall be secured prior to the: <br />Erection, addition or alteration of any building or structure; <br />(2) Use or change of use of a building, structure or land; <br />Change or extension of a nonconfomiing use; and <br />(4) Placement of fill or excavation of materials within the floodplain. <br />Where required by this article or any other zoning provisions, such use pcmiit may <br />require prior review and approval by the planning commission and the council. <br />(Code 1984, § 10.55(19)) <br />Sec. 78-1168. Certificate of zoning compliance. <br />It is unlawful to use, occupy or permit the use or occupancy of any building or <br />premises, or both, created, erected, changed, converted, or wholly or partly altered or <br />enlarged in its use or structure until a certificate of zoning compliance shall have been <br />issued by the zoning administrator stating that the use of the building or land conforms to <br />the requirements of this article. Where a nonconforming use or structure is extended or <br />substantially altered, the certificate of zoning compliance shall specifically state the <br />manner in which the nonconforming structure or use differs from the provisions of this <br />article. <br />(Code 1984, § 10.55(22)) <br />i
