ADMINISTRATION <br />See. 78-1132 Planning Director <br />A Planning Director or designee shall administer and enforce this Ordinance. If the Planning <br />Director finds a violation of the provisions of this Ordinance the Planning Director shall notify the person <br />responsible for such violation in accordance w ith the procedures slated in Section 78-113S of the Ordinance. <br />Sec. 78-1133 Permit Requirements <br />(a) Pennit Required. A Permit issued by the Planning Director in confoimity with the <br />provisions of this Ordinance shall be secured prior to the erection, addition, modification, rehabilitation <br />(including nonnal maintenance and repair), or ullcralion of any building, structure, or portion thereof; prior <br />to the use or change of use of a building, .structure, or land; prior to the construction of a dam, fence, or on­ <br />site septic system; prior to the change or extension of a nonconforming use; prior to the repair of a structure <br />that has been damaged by flood, fire, tornado, or any other souice, and prior to the placement of fill, <br />excavation of materials, or the storage of materials or equipment within the flood plain. <br />(b) Application for Pennit. Application for a permit ahall be mailc in duplicate to the Planning <br />Director on forms funushed by the Planning Director and shall include the follow ing where applicable; <br />plans in duplicate draw n to scale, sluiw ing the nature, location, dimensions, and elevations of the lot; existing <br />or proposed structures, fill, or storage of materials, and the location of the foregoing in relation to the stream <br />channel <br />(c) State and Federal Pcnnits. Prior to granting a permit or processing an application for a <br />conditional use permit or variance, the Planning Director shall dclcnnine that the applicant has obtained all <br />necessary state and federal permits. <br />(d) Certificate of Zoning C'onipliancc for a New , Altered, or Nonconforming Dse. It shall be <br />unlawful to use, occupy, or permit tlic u.se or occupancy of any building oi premises or part thereof hereafter <br />created, erected, changed, converted, altered, or enlarged m its use or structure until a ccrlificaic of zoning <br />compliance has been issued by the Planning Director staling that the use of the building or land conforms to <br />tlie ici|uiicnicnts of this Oidinancc. <br />(c) Construction and Use to be as Provided on Applications, Pl.ins, Pcimits, Variances and <br />C ertilicatcs of Zoning Compliance. Permits, conditional use peimits, or certificates ot zoning compliance <br />issued on the basis of approved plans and applications authorize only the use. arrangement, and construction <br />foitli in such approved plans and apphcalions, and no other use, anangement, or construction. Any use, <br />arrangcmcnl. or consti uctiun at variance with that aulhonzed shall be deemed a violation of this Ordinance, <br />and punishable as provided by Section 78-1138 of this Oidinancc. <br />(0 C'crtificalion.
