ORDINANCE NO__, THIRD SERIES <br />AN ORDINANCE AMENDING THE CITY OF ORONO ZONING CODE <br />SECTION 78-1431 <br />REGARDING CONDITIONAL USE PERMITS <br />ON THROUGH LOTS <br />The City Council of Orono ordains as follows: <br />Section 1; Municipal Zoning Code Section 78-1431 is hereby revised as follows: <br />Sec. 78-1431. Co nditional use pewa it reqnire4. Accessory buildings and structures <br />on through lots. <br />All accessory buildings and structures on through lots located in R districts shall <br />raqii ira n onnditional use permit meet the following requirements: <br />1. The building or structure shall meet the principal building setbacks that are <br />established under sections 78-230. 78-2SS. 78-305. 78-330. 78-350. 78-370. 78- <br />39S. 78-420. 78-444. <br />2. No negative impacts to adjacent neighbors or public right-of-way result in the <br />placement of the building or structure, determined at the discretion of the <br />Planning Director. <br />Should the Planning Director determine that item U2 above cannot be met an accessory <br />structure or building mav be permitted by conditional use permit if the Plaiming <br />Commission determines no negative impacts result in the placement of the building or <br />structure. The Planning Commission mav apply reasonable conditions as part of the <br />approval. <br />Section 2: This Ordinance shall be published in THE PIONEER and THE LAKER <br />newspapers and shall become effective upon approval and publication. <br />Adopted by the City Council of Orono on this 28* day of June, 2004 by a vote of <br />ayes and___nays. <br />Barbara A.
