F <br />1 <br />Draft »2 6-10-04 <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINESOTA <br />PLANNED UNIT DEVELOPMENT NO. 4A AGREEMENT <br />FOR LOTS 1 AND 2, BLOCK 1, STONEBAY ADDITION <br />DEVELOPER: RELIANCE DEVELOPMENT COMPANY LLC <br />THIS AGREEMENT, made and entered into this___day of .,2004, by and <br />between the City of Orono, a municipal corporation organized and existing under the laws of the State of <br />Minnesota (hereinafter called “City ”), and Reliance Development Company LLC, a Minnesota limit;: , <br />liability corporation, its heirs, successors and assigns (hereinafter called “Developer”). <br />WITNESSETH: <br />WHEREAS, the Developer has made application to the City Council for approval of a Planned <br />Unit Development rezoning application (PUD) including a subdivision and a commercial site plan review, <br />for the purpose ofdeveloping two commercial lots, to be legally described as Lots 1 and 2, Block I, <br />STONEBAY ADDITION, Hennepin County, M’nnesota; and <br />WHEREAS, on , 2004 the City Council granted Concept and General <br />Development Plan Approval for development of nvo retail commercial/office buildings totaling 13,930 s.f <br />on Lot 1 and a 14,820 s.f. Walgreens retail building on Lot 2 per Resolution No._____, including <br />approval ofpreliminary design and site plans and establishing final approval conditions, on the condition <br />that the Developer enter into this agreement to provide for conformance with the City ’s Planned Unit <br />Development (PUD) ordinances, to document parameters for the development and use of the site, and to <br />provide for the installation and maintenance of improvements associated with the development. <br />NOW, THEREFORE, in consideration of the premises, and of the actual promises and condkions <br />hereinafter contained, it is hereby agreed as follows: <br />A. Geoeral Terms and Conditions <br />1.Property Description. This Planned Unit Development No. 4A Agreement for Reliance <br />Development Company LLC applies to the following described property located in Hennepin <br />County, Minnesota: <br />Outlot A, STONEBAY, Hennepin County, Minnesota <br />(to be platted as Lots 1 and 2, STONEBAY ADDITION) <br />(hereinafter the “Property”); and <br />Developer Initial_____ <br />City Clerk Initial_____ <br />Page 1 of 12 <br />i
