1I • <br />A <br />A RESOLUTION APPROVING THE <br />GENERAL CONCEPT PLAN FOR PROPERTY <br />LOCATED IN OUTLOT A, STONEBAV <br />FILE NO. 04-2974 <br />Draft ns 6-8-04 <br />WHEREAS, Reliance Development Company LLC (hereinafter the "Developer") has <br />an interest in the property legally described as Outlet A, STONEBAY, Hennepin County, Minnesota <br />(hereinafter the “Property") within the City of Orono (hereinafter the "City"); and <br />WHEREAS, the property is located in the Highway 12 Corridor Study Area for <br />wliich the City has established special requirements for rezoning and development per Municipal Code <br />Sections 78-1061 through 78-1067; and <br />WHEREAS, the City of Orono Highway 12 Planned Unit Development (PUD) <br />ordinance (Municipal Code Sections 78-1001 through 78-1008) requires a multiple step approval <br />process for properties developing via the PUD process; the General Concept Plan approval stage is <br />the lust step in the process followed by the Development Plan approval stage; and <br />WHEREAS, the applicant has requested General Concept Plan Approval for Planned <br />Unit Development of this 3.69 acre property. Proposed is a rezoning from PUD/RR-1B One Family <br />Rural Residential District to PUD/B-6 Highway Commercial District for commercial retail and office <br />use of the parcel. The intended use of the property is for 28,750 s.f. of commercial retail including <br />a 4,9(j 0 K.f. rctail/officc building; an 8,9/0 s.f. rctaiL'office building; and a 14,820 s.f Walgreens retail <br />building; and <br />WHEREAS, the Orono City Council makes the following findings in regard to this <br />application for rezoning and PUD General Concept Plan approval; <br />FINDINGS <br />1. This application was reviewed as Zoning File //04-2974. <br />2.
