A 30 ’ X 18’ pool is proposed to be located 15 ’ from the east and south lot lines. <br />The pool plan includes a terrace/patio that will require retaining walls ranging <br />from 1 ’ to 6’ in height, 5 ’ from the lot line. There is a high likelihood that the <br />property owners will want to place a screening or safety fence above the walls, <br />resulting in the potential visu^ impact equivalent to a building wall as much as <br />12’ high, 5 ’ from the rear lot line and only 40’ from the traveled portion of the <br />Luce Line Trail. <br />While the City has not established special setbacks from the Luce Line right-of- <br />way, and while the proposal would technically meet code, the proposed location <br />of the pool and retaining walls is to some extent a direct result of the lot size. A <br />case might be made that the Planning Commission could, if it chose to, condition <br />lot area variance approval on establishing some greater setback or less-visual- <br />impact location for the pool <br />Issues for Consideration <br />1.
