rr • <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-330 SUBDIVISION B <br />FILE NO. 04-3001 <br />WHEREAS, Steven K. TifTany and Marcia L. Tiffany, husband and wife <br />(hereinaOer “the applicants") are the owners of the property located at 1325 Rest Point <br />Lane within the City of Orono (hereinafter the “City”) and legally described as follows: <br />Lot 74, Tonkaview Gardens, Hennepin County, Minnesota <br />(hereinafter the “propeny"); and <br />WHEREAS, the applicant has made application to the City of Orono for <br />variances to Orono Municipal Zoning Code Section 78-330 Subdivision B for lot area, lot <br />width and side setback variances to allow construction of a single family residence on the <br />property. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #04-3001. <br />The property is located in the LR-IB, Single Family Lakeshore <br />Residential District, which requires a minimum lot area of 1 acre and <br />minimum lot width of 140 ’. <br />3.The Planning Commission reviewed this application at a public hearing <br />held on April 19, 2004 and recommended approval of variances based on <br />the following findings: <br />a. The property has 15,425 s.f. (0.35 acre) in lot area and 75 ’ of lot <br />width. <br />b.
