After-the-fact hardcover variance within the 75’-250’ zone to allow 58.2% hardcover <br />where 25% is allowed and 52.2% was previously approved. <br />2. After-the-fact side yard setback variance in order to allow the newly constructed deck to <br />remain at 4.2’ from the side lot line where 10 ’ is required and the home is setback 3.2’. <br />3. After-the-fact average lakeshore setback variance to encroach 3.5’ into the average <br />lakeshore setback with the newly constructed deck. <br />4. After-the-fact structural coverage variance to allow 21 .4% structural coverage where 1,500 <br />s.f il 7 %) is allowed.___________________________________________________ <br />Planning Commission Recommendation <br />On March 15,2004, Planning Commission voted 6-1 to recommend the following: <br />1. Approval of the after-the-fact hardcover, structural coverage, and side setback variances, <br />2. Denial of the average lakeshore setback variance, <br />3. Removal of a non-conforming lake yard shed which was constructed without approvals by the <br />previous owners. <br />4. The upper-level deck to be reconstructed so as to not increase structural coverage or hardcover <br />levels on the property. <br />Chair Smith was the opposing vote as she felt that additional removals were warranted, <br />Staff Recommendation <br />Approval per the attached Resolution. <br />COUNCIL ACTION REQUESTED <br />Adopt or amend the attached resolution. <br />ji <br />J
