A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-282 & 78-1288 <br />AND A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 78-282,78-1286 AND 78-1250 SUBDIVISION 1 <br />F LE NO. 04-2986 <br />WHEREAS, Dennis Vaillant and Shawn Vaillant, husband and wife <br />(hereinafter “the applicants”) are the owners of the property located at 847 Tonkawa <br />Road within the City of Orono (hereinafter the “City") and legally described as follows: <br />That part of Lot 2, Auditors Subd. No. 217, lying Southeasterly of a line <br />30 feet Southeasterly of and parallel with the Northwesterly line of said <br />Lot 2, Hennepin County, Minnesota <br />(hereinafter the “property”); and <br />WHEREAS, the applicant has made ^plication to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-282 and 78-1288 to allow a <br />reduction in hardcover from 4.5% to 4.2% within the 0-75’ setback zone where 0% is <br />nonnally allowed. <br />WHEREAS, the applicant has made application to the City of Orono for a <br />conditional use permit pursuant to Orono Municipal Zoning Code Section 78-1250 to <br />allow grading within the 0-75* setback zone. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Mirmesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #04-2986. <br />The property is located in the LR-IB, Single Family Lakeshore <br />Residential zoning district, which requires a minimum of 43,560 s.f.
