4 <br />REQUEST FOR COUNCIL ACTION <br />^^004 <br />DATE: Marei^fif ^ <br />ITEM NO: ^ <br />Dcpartncnt Approval: <br />Name RonMoorse <br />Tiilc City Administrator <br />Administrator Reviewed: <br />f) <br />lici^ <br />m Agenda Section: <br />City Administratoi*s Report <br />Item Description: Paul Ode Application for an On-Sale Liquor License at 3425 Shoreline <br />Drive-PublicHearing <br />Background <br />Mr. Paul Ode has applied for an on-sale liquor license for the property at 3425 Shoreline Drive. <br />The liquor license is proposed to be one element of a pizza restaurant and bowling alley concept in <br />the lower level of the “Keaveny” building. <br />The on-sale liquor license {q)plication requires a public hearing to provide an opportunity for the <br />public to ask questions and provide comments regarding the application. <br />Order of Business <br />The following is the suggested order of business for this item: <br />1 . presentation by staff <br />2. presentation by the ^licant <br />3. open the public hearing <br />4. receive questions and comments from the public <br />5. close the public hearing <br />6. Council deliberation <br />City Review <br />The City ’s authority and concern in its review of the liquor license application is the protection <br />of the public health, safety and welfare. The City ’s review of the application has addressed this <br />concern in two ways. One is through a background investigation of the iq)plicant for the liquor <br />license. The second is through a review of the impacts on the area properties of granting the on- <br />sale liquor license. <br />The Police Department has conducted a background investigation of the applicant. Based on the <br />results of the investigation, the Police Department is recommending denial of the liquor licoise. <br />A memo from the Police Chief regarding the recommendation is attached. <br />The key issue in the review of the impacts on the area properties of granting the on-sale liquor <br />license is the proximity to, and orientation of the entrance and parking toward, the adjacent low- <br />density residential development.
