A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />FOR PLUMBING IN AN ACCESSORY STRUCTURE <br />PER MUNICIPAL ZONING CODE <br />SECTION 78-303, SUBDIVISION (17) <br />FILE #04-2976 <br />WHEREAS, James W. Pieipont and Judith A. Pietpont, husband and wife, (hereinafter <br />"the applicants") are owners of the property located at 1801 West Farm Road within the City of Orono <br />(hereinafter "City") and legally described as; <br />Attached “Exhibit A” (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a conditional use permit per <br />Municipal 2!oning Code Section 78-303, Subdivision (17) to allow plumbing including a toilet, bathroom <br />sink and shower to' smain in an existing accessory structure formerly used as a guest house; and <br />WHEREAS, after due published notice and mailed notice in accordance with Minnesota <br />Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held apublic <br />hearing on January20,2004, at which times all persons desiring to be heard concerning this application <br />were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota* <br />nNDlNGS <br />1. This application was reviewed as Zoning File #04-2976. <br />The property is located in the LR-1A Zoniiig District, where 2 acres is the minimum lot <br />area. The property is approximately 4 acres in gross area including wetlands. <br />3.The Planning Commission reviewed this application on Januaiy 20,20t and on a vote of <br />4-1 recommended approval of a CUP for plumbing in the accessory structure, based on <br />the following findings; <br />Page 1 of 6 <br />} <br />' I <br />I
