12 right-of ’way, and will only make use of the easement along Highway 12 if placement of trail <br />in the right-of-way is not possible; and <br />WHEREAS, the Applicants have completed or have agreed to complete all other <br />requirements of the Zoning Code and related Ordinances of the City including: <br />1.Submittal of Minnehaha Creek Watershed District (MCWD) permit approving the <br />grading and stormwater management facilities plan for the development of the <br />Property as proposed per the “Grading, Drainage. Erosion Control, and Utility <br />Plan”, Sheet Cl dated 2-10-04 of Exhibit A. <br />2.Payment to the City of Stormwater and Drainage Trunk Fees for the development <br />of the Property in the amount of $16,588.80 based on Trunk Fee of $6,480 per <br />acre and gross acreage of Property at 111,308 s.f. or 2.56 acres including those <br />portions subject to trail and sidewalk easements. <br />3.Payment of Sewer and Water Connection Charges in the amount of $37,427.20 <br />based on per-acre connection fees for 1989 Highway 12 municipal sewer & water <br />project per 2004 City Fee Schedule of $14,620 per acre and gross acreage of <br />property of 111,308 s.f. or 2.56 acres including those portions subject to trail and <br />sidewalk easements. <br />4.Payment of Park Dedication fee to be confirmed with the County Assessor. The <br />fee would range between $32,000 and $35,520 as discussed in the memo from <br />Planning Director Mike Gaffron, dated April 8, 2004. <br />5.Granting to the City of public easements over existing and proposed trails and <br />sidewalks within the Property and construction of trail along the south boundarj* <br />of the property as shown on the “Landscaping & Lighting Plan”, Sheet LI dated <br />2-23-04. <br />WHEREAS, City staff and consultants have reviewed the plans for this PUD <br />application and hereby specify approval of each attached plan and Identify them as part of the <br />official record for Planned Unit Development No. 4: <br />1.Approval of site plan per “Site Plan” Sheet A1 dated 2-11-04, subject to potential <br />relocation to a location within the Property of the trail currently proposed within <br />the Highway 12 right-of-way. <br />Page 2 of6 <br />1
