ZONINO REGULATIONS { 78-41 <br />(11) Prescribing penalties for the violation of <br />the provisions of this chapter. <br />(Code 1984, § lO.OK(l), (2))) <br />Sec. 78-6. Minimum requirements. <br />In their interpretation and application, the <br />provisions of this chapter shall be held to be the <br />minimum requirements for the promotion of the <br />public health, safety, morals and welfare. <br />(Code 1984, § 10.03(D) <br />Sec. 78*7. More restrictive provisions to ap< <br />ply. <br />Where the conditions imposed by any provision <br />of this chapter are either more restrictive or less <br />restrictive than comparable conditions imposed <br />by any other law. Code provision, statute, resolu <br />tion or regulation of any kind, the regulations <br />which are more restrictive or which impose higher <br />standards or requirements shall prevail. <br />(Code 1984, S 10.03(2)) <br />Sec. 78*8. Prohibitions. <br />It is unlawful to convert, enlarge, reconstruct <br />or alter any structure or use any structure or land <br />for any purpose nor in any manner which is not in <br />conformity with this chapter. <br />(Code 1984, $ 10.03(4)) <br />Sec. 78-9. Vacation ofstreets, alleys and pub* <br />lie grounds. <br />Vacation of streets, alleys and public grounds <br />shall follow the procedures set for^ in this chap <br />ter; except that such vacation shall require a <br />petition by a msdority of the landowners abutting <br />the property to be vacated, and a hearing pre <br />ceded by two weeks' published and posted notice, <br />all as required by Miiui. Stat. i 412 851. The <br />council may vacate any publicly owned utility <br />easement or boulevard reserve which is not being <br />used for sewer, drainage, electric, telegraph, tele <br />phone, gas and steam purposes or for boulevard <br />reserve purposes, in the same manner as vacation <br />proceedings are conducted for streets, alle)^ and <br />other public ways. Abo’ilevard reserve means an <br />easement established adjacent to a dedicated street <br />for the purpose of establishing open space adja <br />cent to the street and which area is designated on <br />the recorded plat as boulevard reserve. <br />(Code 1984, § 10.12) <br />State law reference—Vacating utility easements or bou <br />levard reserves, Minn. Stat. $ 462 358, subd. 7. <br />Secs. 78-10 —78-40. Reserved. <br />ARTICLE II. ADMINISTRATION AND <br />ENFORCEMENT* <br />DIVISION 1. GENERALLY <br />Sec. 78-41. Zoning administrator. <br />(a) This chapter shall be administered and <br />enforced by the zoning administrator, who shall <br />be appointed by the council. <br />(b) The zoning administrator also shall: <br />(1) Determine that all building permits com <br />ply with this chapter; <br />(2) Issue all zoning occupancy certificates and <br />make and maintain records; <br />(3) Conduct inspections of buildings and use <br />of land to determine compliance with the <br />terms of this chapter; <br />Maintain permanent and current records <br />of th:s chapter, including but not limited <br />to all maps, amendments and special uses, <br />variances, appeals and applications; <br />(5) Receive, file and forward all applications <br />for appeals, amendments, variances, spe <br />cial uses or other matters to the desig <br />nated official bodies; <br />(6) Institute in the name of the city any <br />appropriate actions or proceedings against <br />a violator as provided by law; and <br />(7) Serve as an ex officio nenvoting member <br />of the planning commission. <br />(Code 1984, i 10.06(1), (2)) <br />*CroH Kference—AdmiaitUatios. ch. 2. <br />CD78:21
