A hardcover variance in the 75 250 ’ setback zone in order to reduce their existing hardcover <br />from 65.1% (82.2% including rock and plastic) to 59.9% where 25% is allowed. <br />2. Side yard setback variances for the residence in order to add a pitched roof where a flat roof <br />currently exists and add a lull 2"^ story where currently a Vi story exists at a substandard <br />setback of 5.8 ’ where a 10’ side setback is required. <br />The applicants are requesting amendments to their original approvals received in November2003 <br />in order to reconstruct their existing lake yard deck. The reconstructed deck will stall be 2.5 ’ from <br />the side lot line, but will no longer encroach within 75 ’ of the lake. Those amendments are as <br />follows: <br />1. Side setback variance, in order to reconstruct their deck no closer to the side yard than the <br />existing deck (2.5 ’ where 10’ is required), and <br />2. Hardcover variance in order to further reduce the level of hardcover. Currently, 72 s.f. of <br />deck exists extending into the 0-75 ’ setback from Lake Minnetonka. The applicants would <br />like to remove the 72 s.f and re-construct their deck to meet the 75 ’ setback from the OHWL. <br />Thus reducing the level of hardcover within the 0-75 ’ zone by an additional 2.4%.______ <br />STAFF RECOMMENDATION <br />Planning Department staff recommends approval as presented per the attached resolution. Or <br />Council could refer the request back to the Planning Commission for additional review. <br />COUNCIL ACTION REQUESTED <br />Adopt or amend the attached resolution. <br />---------
