Items A and B designate the RGU for <br />the type of project llstedt <br />A. for harvesting of timber for commercial purposes <br />on public lands within a state park, historical area, wilderness <br />area, scientific and natural area, wild and scenic rivers <br />district, the Minnesota River Project Rlverbend area, the <br />Mississippi headwaters area, or critical area that does not have <br />an approved plan under Minnesota Statutes, section 86A.09 or <br />11SG.07, the DRR shall be the RGU. <br />B. for a elearcuttlng of 60 or more contiguous acres <br />of forest, any part of which Is located within a shoreland area <br />and within lOO feet of the ordinary high water nark of the lake <br />or river, the OHR shall be the RGO. <br />Subp. 29. Aolaal feedlots. The PCA la the RGO for the <br />types of projects listed In Items A and B unless the county will <br />issue the feedlot permit. In which ease the county Is the RGO. <br />However, the county Is not the RGO prior to January 1, 2001. <br />A. for the construction of an animal feedlot facility <br />with a capacity of 1,000 animal units or more or the expansion <br />of an existing facility by 1,000 animal units or mors if the <br />facility is not In an area listed in Item B. <br />B. for the construction of an animal feedlot facility <br />of more tixan 500 animal units or expansion of an existing aniisal <br />feedlot facility by more than 500 animal unita if the facility <br />la located wholly or partially In any of the following sensitive <br />locationst shoreland| a delineated flood plain, except that in <br />the flood plain of the Red River of the North the sensitive area <br />ineludes only land within 1,000 feet of the ordinary high water <br />aarki a state or federally designated wild and scenic river <br />district I the Minnesota River Project Rlverbend area; the <br />Mississippi headwaters area; or an area within a drinking water <br />supply management area delineated under chapter 4720 where the <br />aquifer la Identified in the wellhead protection plan as <br />vulnerable to contamination; or within 1,000 feet of a known <br />sinkhole, cave, resurgent spring, disappearing spring, Rarst <br />window, blind valley, or dry valley. <br />The provisions of part 4410.1000, aubpart 4, regarding <br />connected actions do not apply to animal feedlots. The <br />provisions of part 4410.1000, subpart 4, regarding phased <br />actions apply to feedlots. <br />With the agreesent of the proposers, ■the RGU may prepare a <br />single EAN to collectively review Individual sites of a <br />Rultislte feedlot proposal. <br />Subp. 30.
