iri <br />MaxwtII Bay Estatas <br />EAW Nctd DatarniaatioB <br />March S, 2004 <br />PagaSof S <br />Concern Scania Viawa and Vioiit , . <br />**Sincc Lake Minnetonka provides for a multitude of scenic viewing opportunities, an <br />evaluaHon of the visual impacts from the proposed development must be conducted ” <br />Due to the average lakeshore setback requirement any house construction will be 260 - 500 feet <br />from the shoreline, preserving the current scenic views from the lake. Also, the City h« a well <br />established ordinance which regulates any vegetation removal or alternation within 75 of the lake <br />further preserving the natural appearance of the shoreline. <br />Conclusion A Staff Recommendation ^ . u <br />It is staffs opinion that the issues raised in the Citizen Petition have been and will contmue to be <br />addressed during the subdivision review process. Further, because the 6 lot propos^ has been <br />withdrawn and a new 3 lot proposal has been submitted the proposal will have to be review^ again <br />by the Planning Commission where attempts can be made to lessen any environmratal impact <br />which may exist. Staff believes it is reasonable and appropriate to make a fmding that this <br />development (being the revised 3 lot plan) has no potential for significant environmental effects due <br />to the following reasons: <br />1. The petitioners have withdrawn their petition, <br />2. The 6 lot proposal has been withdrawn by the applicants, <br />3. The new proposal for a 3 lot subdivision significantly reduces the potential for significant <br />environmental impacts and is looked at favorably by the petitioners, and <br />4. The issues discussed in the environmental letter (and above) do not pose the potential for <br />significant environmental impacts, regardless if the property is subdivided into 6 lots or 3 <br />lots. <br />COUNCIL ACTION REQUESTED <br />Adopt the attached Resolution finding that the Maxwell Bay Estates subdivision will have no <br />potential for significant environmental effects, and determining that an EAW will not be required. <br />‘.i
