Council approval is based on the site grading and wetland restoration plan submitted by the applicants tutd annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the plan which are not in conformity with the approved plan will at the discretion of City staff require further Planning Commission and City Council review. The applicant shall provide the City with a copy of the executed buffer preservation declaration required by the MCWD. The applicant shall provide to the City copies of the required ongoing wetland restoration monitoring reports as required by the MCWD. The applicant shall execute the standard Flowage and Conservation Easement over the wetland and its MCWD-required buffers. The applicant and his agents shall comply with all permit requirements of the various agencies having jurisdiction over this wetland. The applicant shall apply for and obuun a land alteration peimit from the City prior to commencing the project. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a land alteration permit for the project within one year of the date of Council approval, or the variance will expire on that date (February 23, 2005). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants’ heirs, successors and assi^, hereby agree to the recording of this resolution in ihe chain of title of the property.
