1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br />9. <br />Council approval is based on the site grading and wetland restoration plan submitted by the <br />applicants tutd annotated by City staff, attached to this Resolution as Exhibit A. Any amendments <br />to the plan which are not in conformity with the approved plan will at the discretion of City staff <br />require further Planning Commission and City Council review. <br />The applicant shall provide the City with a copy of the executed buffer preservation declaration <br />required by the MCWD. <br />The applicant shall provide to the City copies of the required ongoing wetland restoration <br />monitoring reports as required by the MCWD. <br />The applicant shall execute the standard Flowage and Conservation Easement over the wetland <br />and its MCWD-required buffers. <br />The applicant and his agents shall comply with all permit requirements of the various agencies <br />having jurisdiction over this wetland. <br />The applicant shall apply for and obuun a land alteration peimit from the City prior to commencing <br />the project. <br />Authorities granted by this resolution run with the property not with the applicants, but are <br />permissive only and must be exercised by obtaining a land alteration permit for the project within <br />one year of the date of Council approval, or the variance will expire on that date (February 23, <br />2005). <br />Violation of or non-compliance with any of the terms and conditions of this resolution shall <br />constitute a violation of the zoning code, shall automatically terminate any authority granted herein, <br />and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms of this resolution <br />and on behalf of the applicants and the applicants’ heirs, successors and assi^, hereby agree to <br />the recording of this resolution in ihe chain of title of the property. <br />Page 4 of 7 <br />• .1 • <br />I <br />.? !
