A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1288 SUBDIVISIONS A & B <br />FILE NO. 04-2981 <br />WHEREAS, Jeffrey L. Martineau and Melissa L. Oninger, husband and <br />wife (hereinafter “the applicants”) are the owners of the property located at 2565 North <br />Shore Drive within the City of Orono (hereinafter the “City”) and legally described as <br />follows: <br />Attached as Exhibit A <br />(hereinafter the “property”); and <br />WHEREAS, the applicant has made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1288 to allow a reduction in <br />hardcover from 21.61% to 21.18% hardcover within the 0-75’ setback from the OHWL <br />of Lake Minnetonka. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />3. <br />This application was reviewed as Zoning File #04-2981. <br />The property is located tn the LR-IA, Single Family Lakeshore <br />Residential zoning district, which requires a minimum lot area of 2 acres. <br />The Planning Commission reviewed this application at a public hearing <br />held on February 17, 2004 and recommended approval of a hardcover <br />variance based on the following findings; <br />a. A total of 2,608 s.f. of hardcover exists in the 0-75’ setback zone <br />where none is allowed. This hardcover consists of a home, deck, patio <br />and retaining walls. <br />b. There is cunently 21.61% hardcover in the 0-75’ setback zone, and a <br />total of 25% or 7,530 s.f for the combined areas of 0-75’ and 75’- <br />250’ setback zones.
