A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1434 (1) & (2) <br />nLE NO. 03-2958 <br />WHEREAS, Judson M. Dayton and Elizabeth J. Dayton, husband and <br />wife, (hereinafter “the applicants") are the owners of the property located at 2885 Little <br />Orchard Way and 825 Old Crystal Bay Road within the City of Orono (hereinafter the <br />“City”) and legally described as follows: <br />2885 Little Orchard fVay: <br />Lot 3, Block 1, LITTLE ORCHARD, Hennepin County, Minnesota <br />825 Old Crystal Bay Road: <br />Refer to Exhibit A, attached to this resolution <br />(hereinafter the “property ”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for variances to Orono Municipal Zoning Code Section 78-1434 (1) & (2) to allow the <br />existing bam, currently located at 2885 Little Orchard Way, to remain in its current size <br />of 1,152 square feet. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #03-2958. <br />The property located at 2885 Little Orchard Way and 825 Old Crystal <br />Bay Road are located in the LR - lA zoning district, which requires <br />minimum lot sizes of 2 acres. 2885 Little Orchard Way is 2.0 acres in size <br />and 825 Old Crystal Bay Road is approximately 21.0 acres in size. <br />3.The Planning Commission reviewed this application at public hearings <br />held on October 20, 2003 and January 20, 2004 and recommended denial <br />Page 1 of 5
