«2484 - Woodhill CC <br />May 5, 1999 <br />Page 3 <br />Public Hearing Notificalion <br />Notice of the Public Hearing was published in The Pioneer and The Laker on April 24. 1999 and <br />May 1. 1999. Written notice to all properly owners within 350' of the properly boundaries and <br />within 350’ of Woodhill Avenue was mailed on Tliursday. April 29, 1099. <br />Additional Permits and/or NotiflcationsWhich May Re Required <br />Other permits which may be required in conjunction with the proposed driveway access include: <br />a) permit for work in right-of-way; <br />b) permit for land alteration; and <br />c) CUP for land alteration exceeding 500 cubic yards <br />The above permits will be held in abeyance pending the result of this land use C'l IP apjilieation. <br />d) Minnesota Statutes require notification of fee holders when trees arc to be cut within <br />dedicated right-of-way. <br />Application Rackgroimd <br />In May 1908 Woodhill Country Club did grading work within the Club property and within the <br />deilieated right-of-way of Woodhill Avenue to re-*>pen a driveway access frt)in the Club property <br />to Woodhill Avenue, which access had been closed by the Club since approximately 1980. <br />riic City stopiK ’d the work upon being advised it had occurred, and indicated to Club rcprcsentali /es <br />that certain permits and approvals would have to be obtained by the Club in order U> leiain the • cork <br />that had been ei>inpleted and for the access to Woodhill Avenue to be used. <br />Subsequently a number of public ami lUMi-public meetings (»ccurred between and among Club <br />representatives, the City Council, stall, and the immeiliate neighbors potcntiall) affected by the re <br />opening of the access. The City refused tt> sanction Wcrodlull's use of Woodhill AN cnue without the <br />proper (T IP public review priKess. Woik H u H refused to make such an application. In July 1998 the <br />Club filed suit again.st Orono. claiming that Woodhill has a right to open and u.se the Woodhill <br />Avenue access without City approval. <br />The lawsuit proceeded with discovery through March 190U. in April 1999 Woodhill proposed a <br />settlement procedure by which Woodhill would apply to the City for a CUP to allow opening and <br />use of the Woodhill access on a limited basis. Woodhill filed the current applicatiim on April 14. <br />1999. I his application was deemed by stall to be substantially complete as ol April 30. 1999 upon <br />receipt of the trafllc study by Parsons RrinckerholT. <br />• i
