Authorities granted by this conditional use permit run with the property not with the <br />applicant. <br />10. Violation of or non-compliance with any of the tenns and conditions of this resolution shall <br />constitute a violation of the Zoning Code per Section 10.09, Subdivision 12 and Section <br />10.99, and may terminate any authority granted herein, after review by the Council. <br />11. The undersigned applicant has read and understood the terms of this resolution, hereby <br />agrees to Conditions 1-10, and on behalf of itself, its heirs, successors and assigns, hereby <br />agrees to the recording of this resolution in the Chain of Title of the Property. <br />12. The applicant asserts that its agreement to the conditions of this Resolution is made solely <br />on the condition that it does not waive and is without prejudice to applicant’s claim of right <br />to use the Woodhill Avenue access without limitation and without further amendment of its <br />1968 CUP, which claim of right the City denies. <br />13.
